Indiana Car Insurance Coverage and Rates

You know you need to carry a minimum amount of car insurance to be road-legal in Indiana. But from there, car insurance gets more complicated.

There are so many options to choose from, and you don’t really know how much insurance you should carry. Not only that, but how do you know what’s a reasonable rate to pay for your coverage?

We’ll start with a look at the legally required coverage, then we’ll cover some options. And we’ll also provide some rates from the top companies for several different types of driver and locations thanks to Quadrant’s data.

Indiana Minimum Car Insurance Coverage

Indiana law requires all drivers to be financially responsible for a car accident in which they are found at fault. That responsibility is handled by your car insurance.

The legally required minimum coverage  are:

• Bodily injury coverage of $25,000 per person and $50,000 per incident
• Property Damage of $25,000 per incident
• Uninsured Motorist Bodily Injury and Property Damage coverage at the same limits as your liability (25/50/25)
• Underinsured Motorist Bodily Injury coverage in the amount of $50,000

According to the Indiana Department of Insurance, Uninsured and Underinsured Motorist coverage is required unless you choose to waive it. You must waive it in writing.

While it’s always a good idea to have a paper copy around, Indiana does make Allstate’s list of states where electronic proof of insurance is accepted.

Forms of Financial Responsibility

Although the most common form of financial responsibility is car insurance, Indiana drivers do have a couple of alternatives.

First, you can self-insure. While most states require that you have a fleet of at least 25 cars in order to self-insure, Indiana has no such minimum requirement.

That means you can apply for a certificate of self-insurance. According to the Indiana state code, you must provide proof of your ability to pay a judgment against you for bodily injury or property damage.

You can also provide a bond in the amount of $40,000 in lieu of insurance in Indiana.

For most people, however, insurance is the most financially feasible manner of complying with the law.

Premiums as a Percentage of Income

You work hard for your income, but there are a lot of things you have to pay for after Uncle Sam takes his percentage. Out of that disposable income, you have to pay for things like groceries, car payments, rent, and of course your car insurance.

Indiana drivers pay less than the national average in terms of percentage of income spent on car insurance. They’re about on par with neighboring Illinois, where drivers spend about 2.02 percent on average on car insurance.

To the east, drivers in Ohio have a slightly lower cost of car insurance, spending on average 1.72 percent of their disposable income.

Additional Liability

On top of the required liability insurance, there are additional car insurance coverage types. While uninsured and underinsured motorist coverage is required by law unless waived in writing, the option to waive still makes it a non-compulsory coverage.

Uninsured and Underinsured (UM/UIM) motorist coverage is there to protect you from the risk of an accident with a driver who has either no insurance at all or whose insurance coverage isn’t sufficient to pay the damages.

Indiana ranks eighth for unisured drivers in the nation, with 16.7 percent of drivers not carrying any coverage, according to the Insurance Information Institute.

While you have the right to sue an uninsured motorist, it can be time-consuming and difficult to recoup losses from a driver who may not have any financial resources to pay the judgment.  Uninsured motorist coverage can take care of your injuries or damage right away.

The same applies to an underinsured motorist. It’s a little more tricky to determine who is underinsured since you aren’t underinsured until you’re in an accident where the damage exceeds your limits.

For someone carrying the legal minimum, the odds of being underinsured are fairly high, since a serious accident can quickly exceed the limits of the policy.

Medical Payments coverage is another option that protects you from the costs associated with an injury. This coverage is a “no-fault” option; it pays medical bills for you and your household regardless of who was at fault in the accident.

Below you’ll find the loss ratios for both of these coverages as compared to the national average, provided by the National Association of Insurance Commissioners (NAIC).

A loss ratio tells us how much insurance companies are paying out in claims compared to how much premium they have taken in.

Loss ratios over 100 percent indicate financial difficulty – companies taking in less than they are paying out. Low ratios, however, mean they aren’t paying out as they should be.

Indiana’s loss ratios for both UM/UIM and Medical Payments coverage are above average. This may reflect the high number of uninsured drivers in the state.

Here’s a look at the National Association of Insurance Commissioners (NAIC) data on car market share for car insurance companies in Indiana. State Farm holds nearly a quarter of the market share in Indiana, which isn’t surprising since they offer some of the lowest rates as well.

There are a total of 1,022 property and casualty insurance companies licensed in Indiana.

Of those 64 are domestic (are incorporated in the state) and 958 are foreign (incorporated in other states).

State Laws

There are a lot of Indiana laws in place to protect you and everyone else. They govern how insurance companies run their business, who can be licensed to drive and how to get that license, and how drivers should behave on the road.

You know it’s important to be aware of the laws, but there are so many and it seems like they are constantly changing. How can you keep track?

In this next section, we will cover the laws you really need to know in order to stay legal on the road.

We have dug through the statutes and translated all the legal language to provide a clear look at the laws in Indiana. First, we will look at insurance laws, then cover driver and vehicle licensing before wrapping up with the safety laws on Indiana’s roads.

Car Insurance Laws

This section will focus on all of the laws that govern car insurance, helping you to understand your rights and responsibilities.

How Indiana Insurance Laws Are Determined

According to the NAIC, Indiana law allows car insurance companies to file and use rates without the need for prior approval.

Indiana’s laws governing motor vehicles are found in Title 9 of the state code, while insurance laws are found in Title 27. All laws are determined by the Indiana General Assembly.

Windshield Coverage

Indiana doesn’t have any laws specific to how car insurance companies cover damage to windshields. That means it will be covered under comprehensive insurance and usually subject to that deductible. Some companies may offer a deductible waiver on windshield repair.

According to CarWinshields.info, if your car is at least five years old you can choose from an OEM, aftermarket, or used windshield for your replacement.

High-Risk Insurance

Being classified as a high-risk driver is usually the result of multiple tickets, accidents, and major violations on your driving record. Sometimes, factors like poor credit and other issues can also place a driver on the high-risk list.

High-risk drivers sometimes find themselves unable to get insurance from standard car insurance companies. There are a lot of non-standard companies out there that cater to these drivers, providing coverage for most situations. In some cases, however, even a non-standard company may turn a driver down.

The Indiana Automobile Insurance Plan (IAIP) is a high-risk insurance pool that was created to help everyone get coverage, regardless of their driving record. All insurance companies are required to participate, and the plan assigns drivers to a company, spreading the risk among all carriers.

The high-risk insurance pool is a last resort option. It’s only for drivers that have been turned down on the voluntary market.

High-risk insurance is expensive, so while you can get the coverage you need to be legal, it should be a temporary solution while improving your record to get a better policy. As soon as you can qualify for a voluntary policy, you can cancel your IAIP policy and move on to what should be a more affordable option.

In Indiana, some high-risk drivers are required to file an SR-22. This is a financial responsibility filing that the state requests from the insurance company to prove you’re covered. It’s usually required in cases of major violations or for drivers that have violated the financial responsibility laws.

While any company can file an SR-22 on your behalf, not all of them offer the service. Most non-standard companies do, however, since their focus is on serving the high-risk market.

Low-Cost Insurance

Indiana doesn’t offer any sort of state-sponsored plan for low-income families to help with insurance costs.

Thanks to relatively low average rates and the many options for car insurance companies in the state, you can find a lower rate by shopping around and comparing options.

Automobile Insurance Fraud in Indiana

Insurance fraud is a crime in Indiana and can land you in some serious trouble. Fraud can range from what is known as “soft fraud”, like a white lie on your insurance application, to “hard fraud” which involves a concerted attempt to defraud (like staging an accident).

According to the Insurance Information Institute, fraud accounts for about 10 percent of losses in the insurance industry.

Fraud can result in a variety of penalties depending on the type and amount of the fraud. For lying on an application, you can be charged with a misdemeanor that carries penalties of up to a year in jail and a $5,000 fine.

If the amount of the fraud is $2,500 or more, the charge will be a felony. Felony charges can result in fines of up to $10,000 and jail time of up to 2.5 years for a first conviction and up to six years for a repeat conviction.

The Indiana Department of Insurance requests that fraud be reported through the NAIC. You can report online or by calling 800-835-6422.

Statute of Limitations

In Indiana, the statute of limitations for bodily injury and property damage is the same. You have two years to file your claim in either case.

Vehicle Licensing Laws

This next section will cover all of the laws that pertain to driver and vehicle licensing in Indiana.

REAL ID

The REAL ID Act of 2005, enforced by the Department of Homeland Security, places a higher level of restriction on the type of identification that can be used to enter a government facility or pass through security at an airport. That includes domestic flights, where most people use a driver license as their identification.

As of October 1, 2020, the only driver license accepted by TSA will be the REAL ID, which is issued to drivers who present more documentation when renewing or applying for a license.

Indiana is compliant with the REAL ID Act, and drivers can obtain the new license at any BMV office. In order to obtain your new license, you will need to present the following:

• Proof of identity
• Proof of legal presence in the United States
• Social Security Number
• Proof of Indiana residency
• Proof of legal name change if applicable

Although REAL ID is an option in some states, all newly issued Indiana licenses are required to be compliant.

Penalties for Driving Without Insurance

Driving without insurance in Indiana can get you into some serious trouble. You should carry proof of insurance or an alternative (self-insurance or surety bond) at all times. You will be required to provide that proof to law enforcement on request.

The BMV will also verify your insurance information in these situations:

• When you are involved in an accident that is reported to the BMV
• When you receive a third pointable moving violation within one year
• For any serious moving violation
• When you receive a pointable violation and have previously been caught driving uninsured

In the above situations, you will receive a request for proof of insurance by mail, to which you are required to respond.

Your insurance company will then need to file a Certificate of Compliance with the BMV proving you have the required coverage. Failure to submit the certificate within 90 days will result in the suspension of your driving privileges.

A conviction for driving without insurance can result in penalties that increase with each offense.

Teen Driver Laws

Indiana uses a Graduated Driver Licensing program (GDL) to train teen drivers and prepare them for the responsibilities of a full license. This program, like most of its kind, has three stages. At each stage, the teen driver is given increasing responsibility, with restrictions in place to keep teens safe as they learn to drive.

The steps to the graduated license program are outlined on the Indiana BMV website, and are as follows:

Older Driver License Renewal Procedures

If you are 75 or older, specific rules apply to how and when you can renew your license.

Drivers aged 75-84 must renew their license every three years. After age 85, the renewal cycle is every two years.

After age 75 you will also be required to provide proof of adequate vision at every renewal. AS of January 1, 2020, drivers of all ages will be eligible to renew online or by mail every second renewal.

New Residents

If you have moved to Indiana, you will need to get an Indiana driver license. Indiana requires that you visit a BMV location within 60 days in order to transfer your license.

You will need to surrender your valid out-of-state license in order to obtain an Indiana license. You’ll also need to provide proof of lawful status in the U.S., proof of Indiana residency, and your Social Security card in order to receive the new REAL ID license.

As long as you have had a valid license for more than one year, only a vision test is required. If your license is expired or you’ve held it for less than a year, a driving skills test will be required.

Drivers under the age of 18 will need to hold a provisional license for 180 days before being issued a full license.

License Renewal Procedures

The license renewal cycle in Indiana is every six years.

You can renew online or by mail every second renewal; at each in-person renewal, you will need to present proof of adequate vision.

Bear in mind that if you don’t yet have a REAL ID license, you will need to bring additional documentation to your renewal in order to upgrade your license.

Negligent Operator Treatment System

Indiana uses a points system to track violations by drivers. Each violation carries a points value ranging from two to 10. Here are some examples of violations and their points count:

• 1 – 15 miles per hour over the speed limit: two points
• 16 – 25 miles per hour over the speed limit: four points
• 26+ miles per hour over the speed limit: six points
• Failure to use headlights: two points
• No brake or signal lights: two points
• Improper motorcycle headgear: four points
• Improper motorcycle passenger: four points
• Improper U-turn: four points
• Unsafe lane movement: four points
• Disregarding a stop sign or yield sign: four points
• Failure to yield to an emergency vehicle: six points
• Following another vehicle too closely: six points
• Driving while suspended: eight points
• Speed contest on road: eight points

Points stay on your record for two years before expiring. During that time, they can accumulate.

You can take a driver safety course to reduce your points by four once in any three-year period.

The BMV will notify you by mail if a Driver Safety Course is required, after which you will have 90 days to complete the course. This may also be court-ordered. Failure to complete the course will result in a license suspension.

There are several situations in which your driving privileges may be suspended for violations:

• 10 traffic tickets in a 10-year period, one of which is a major offense: five-year suspension
• Three major offenses in a 10-year period: 10-year suspension
• Two major offenses resulting in injury or death in a 10-year period: 10 years to life suspension

Other reasons you could have your license suspended include:

• Failure to appear in court/pay fines: suspended until you appear or pay
• Operating a Vehicle or Watercraft while intoxicated: Suspension varies (see DUI penalties below)
• Failure to pay child support: until resolved in court
• Payment to BMV with dishonored funds: until paid

Rules of the Road

This section covers the rules of the road all drivers need to follow, from seat belts to speed limits.

Fault Vs. No-Fault

Indiana is a fault state. That means that the driver found to be at fault in an accident is responsible for damages. In most cases, that means the driver’s liability insurance will cover the cost of injuries and property damage.

However, a driver that is uninsured or whose limits are exceeded can be held personally responsible in court for excess damages.

Indiana uses a modified comparative fault system, which means the other driver must be at least 51 percent at fault in the accident in order for you to pursue personal injury damages in court. In other cases, you may still be able to file a suit, but your damages will be reduced by your percentage of the fault in the accident.

For example, if you are found to be 30 percent at fault, you can file a lawsuit, but your damages will be reduced by that percentage. So, in a 10,000 lawsuit, you can recoup only $7,000.

Seat Belt and Car Seat Laws

Seat belts are required in Indiana for all vehicle occupants over the age of 16, in all seats.

All children aged seven and younger must be restrained in a proper car seat or booster seat. The law makes no provisions for height, weight, or age, nor does it state any preference for the rear seat. Children between the ages of eight and 15 can use an adult seat belt.

It’s important to note that the American Academy of Pediatrics has its own recommendations for car seat use that are not reflected in the state laws.

Indiana has no state laws regarding riding the back of a pickup truck.

Keep Right and Move Over Laws

Drivers in Indiana are required to keep right unless they are passing or moving slower than the speed of traffic. Passing on the right isn’t permitted except in a few circumstances:

• A vehicle is making a left turn
• There are more than two lanes of traffic on the road
• It is safe to do so and the driver is not traveling on the shoulder

When passing a stopped emergency vehicle, tow vehicle, municipal, or utility vehicle with lights flashing, drivers must move over to another lane or slow to at least 10 mph under the speed limit.

These laws are outlined in the Indiana codes.

Speed Limits

Indiana’s speed limits are:

• 70 mph on rural interstates (65 for trucks)
• 55 mph on urban interstates
• 60 mph on other limited-access roads
• 55 mph on all other roads

Speed limits vary and may be lower especially in constructions zones. The posted limit is always the one you should follow.

Ridesharing

Rideshare drivers in Indiana are required to carry liability insurance that meets the state minimums. While Uber or Lyft will offer you $1 million in coverage from the time you accept a passenger to the time you drop them off, you’re not covered by them when you have the app on but haven’t yet accepted a ride.

Your personal insurance will cover you when you don’t have the app on but offer no coverage as soon as you do turn it on. That leaves a gap in coverage that can be resolved with a rideshare endorsement. Many insurance companies offer this sort of endorsement.

Bear in mind that failure to notify your personal insurance company of your rideshare driving activities can result in the company canceling your coverage. You are required by the terms of your policy to report any business activity in the vehicle to the insurer.

Autonomous Vehicles

While the Indiana government is still working on regulations that will govern how automated vehicles can be used on the road, there are currently no laws in place.

Hoosiers will have to wait a little longer for this wave of the future to hit.

Safety Laws

These last few laws are designed to make sure that drivers on Indiana’s roads are safe, in control, and focused on the road.

OWI (Operating While Intoxicated) Laws

It’s illegal to drive with a blood alcohol content (BAC) of over 0.08 percent in Indiana. A BAC of .15 percent or higher is classified as a “high BAC”, which carries stiffer penalties.

In 2017, Responsibility.org reports, 220 traffic fatalities were the result of a driver under the influence.

A DUI can also result in the requirement for SR-22 insurance.

Marijuana-Impaired Driving Laws

Indiana has a zero-tolerance law for driving under the influence of marijuana.

You can be charged with an OWI for any amount of THC or its metabolites in your system. As with all OWI charges, law enforcement can use their own judgment to determine a driver’s level of intoxication.

Distracted Driving Laws

Indiana currently has no handheld cell phone ban with the exception of drivers under 21.

Car Ownership in Indiana

Hoosiers are a little above average for households with two or more cars. More than 42 percent own two cars, and more than 22 percent own three.

Commute Time

Indiana drivers have an average commute time of 22.6 minutes, which is below the national average. There are also fewer drivers with commutes of 40 minutes or more than the national average.

Commuter Transportation

The vast majority of Hoosiers drive alone to work – a whopping 82.4 percent.

Traffic Congestion in Indiana

Not everyone is racing in Indiana. Inrix ranks Indianapolis as the 38th most congested city in the United States and 177th in the world.

An average of 59 hours a year is wasted per driver in congestion, at a price tag of $826 annually.

At peak time, the average speed is 29.66 mph, while in off-peak it’s 36.83. Free-flowing traffic moves at 42.61 mph on average.

The good news is, even if people from the Region say they’re from Chicago, few Hoosiers have to deal with that city’s traffic.
