The Basics of Auto Insurance in North Dakota

North Dakota law requires that all drivers in the state carry a minimum level of car insurance. This helps to make certain that everyone on the road is financially responsible in the event of an accident.

The law requires bodily injury liability coverage in the amount of $25,000 per person and $50,000 per incident. Property damage liability coverage must be at least $25,000. Also required by law are uninsured/underinsured motorist coverage, at the same bodily injury limits of 25/50. Your underinsured motorist limits must match the uninsured motorist limits. There is no requirement for property damage coverage in this category.

Finally, as a no-fault state, North Dakota requires that all drivers carry at least $30,000 in no-fault coverage, or personal injury protection (PIP). This coverage pays for medical bills, lost income, and other financial issues related to an accident for you and anyone in your household.

North Dakota’s legal minimums are fairly similar to those in other states, although they do require more PIP coverage than many other no-fault states.

In addition to what the law requires, drivers may also need to meet the requirements in a loan or lease agreement. Financed and leased vehicles usually need to have comprehensive coverage and collision coverage, and there may be further requirements. Check your agreement to find out what you need to carry.

Specifics of North Dakota Auto Insurance

As we have already mentioned, North Dakota is a no-fault state. That means that after an accident each party files directly with their own insurance company, which pays out PIP benefits as the first line of defense regardless of who is at fault.

This does not mean, however, that no one will be considered at fault or that there will be no consequences. Property damage doesn’t fall under no-fault laws, so you are responsible for damage if you are found at fault. Your insurance company will pay up to the limits of your policy, after which you will be personally responsible.

While the PIP system avoids many lawsuits, a driver can still be sued for pain and suffering if the medical bills exceed $2,500 for one individual, or if the accident causes a serious injury or disfigurement that lasts more than 60 days. If either of these requirements is met, the at-fault driver can be taken to court. The liability coverage on your policy can pay for court costs and judgments against you – but only up to the limits you choose.

As one final note on North Dakota car insurance, drivers should know that if they cross the Canadian border to the north their insurance policy does follow them. Unlike Mexico, Canada does recognize and accept U.S. insurance policies, but it is still good to check with your insurance company before you go to see if there is anything you should know.
